Sales Terms and Conditions

It is clients responsibility to keep themselves current on our Terms and Conditions as they are publicly advertised and are updated from time to time for their protection and ours.

For better service please be advised that calls regarding sales and contracts may be recorded

Please be advised we do not let horses go on trial under any circumstances.

Please be respectful and inform your trainers and vets of our policies and do not schedule a presentation if your intention is to ask for a trial. These are live animals and we do not take them off the market or put undue risk on them out of our care. ALL HORSES ARE REQUIRED TO BE VACCINATED with the recommended vaccines required by Shirefoxfarm and its representatives

We have many happy owners that will gladly attest to our honesty and integrity about our horses

All prices are subject to change as we put more training and effort into each horse.  Sales for clients have a 90-day minimum "exclusive" and are responsible for all grooming and presentation time and expenses separate from commissions.

All horses are photographed before leaving our care and will not be released without proper documentation and proof of their condition before loading on transports

All attorneys fees, expert witnesses, and any and all other costs pertaining to a legal action will be awarded to the prevailing party should legal action arise.

To protect Sellers and Buyers privacy of financial information we take PayPal. Please make sure all tranfers are accessible to PayPal ahead of time when a deposti is made for intent to purchase. This is especially important with the 5 day Quick Sale Policy so Buyers can be rewarded and get their negotiated discount. Once horses pass their Vet exams or vet exam is waived full balance is immediately due.

Shirefoxfarm reserves the right to hold deposits should a second oppinion or prepurchase exam be needed if veterinarians findings seem questionable. Deposit will be held until findings can be responded to or verified

The terms of any purchase agreement with Shirefox Farm, its promoters, owners or agents shall be governed by the laws of the state of Washington. Any legal action must be brought in Pierce County, WA or in the case of arbitration both parties to the agreement mutually agree that any and all disputes arising in connection with this agreement shall be settled and determined by binding arbitration conducted in accordance with the then existing rules of the American Arbitration Association by one or more arbitrators appointed in accordance with said rules. Said arbitration shall take place in Tacoma, WA.

NOTE: Be advised that obviously if a horse is in our care or are being presented by us to clients for sale, our sales terms are absolute and clients are acknowledging agreeing to them with full absolute respect to and agreeing to abide by all terms of our sales terms policies. We offer all potential buyers plenty of time to access the horse they are seeking to purchase and offer to clinic them with the horse before making their decision All Sales are Final. No Refunds once horses pass their veterinarian exam. If veterinary prepurchase exams are waived deposits are non refundable as we only take deposits with intent to purchase.

Because of the number of horses purchased by out of state buyers, please understand that no horses can be “held” without a deposit and pre-purchase agreement. All out-of-state buyers have choice of using a local vet, or arranging for their own vet to perform a pre-purchase exam, including x-rays, on premises. Shirefox reserves the right to be privy to all veterinarian's findings upon completion of exam including x-rays.  X-rays shall become a part of the horse's medical records and will not be transferred to another veterinarian until the horse is paid for.  Upon buyer's receipt of a passing pre-purchase exam from the vet chosen, deposit is applied to purchase price and remaining balance is due. If veterinary pre-purchase exams are waived deposits are non refundable as we only take deposits with intent to purchase. Payments must be made by cash or wire transfer only—no personal checks. Prices are negotiable only under the terms of a Quick Sale (see below).

Quick Sale Policy

  1. Buyer contacts Shirefox and a 5-day Quick Sale discounted price is established between the buyer and Shirefox on a specific horse;
  2. A *non-refundable* deposit (15% of purchase price over $10,000 or $1,500 for horses priced under $10,000) is sent by buyer via wire transfer or cashier's check;
  3. Vet check is immediately arranged upon receipt of deposit;
  4. Horse is vetted, buyer is notified of vet's findings (pass or fail);
  5. Balance is due upon completion of (passing) vet check;
  6. Transportation arrangements are made between buyer and Shirefox after horse passes vet check, and balance due is received via wire transfer (sorry, no personal checks).

A Quick Sale transaction takes no more than 5 days, including weekend days, from the time the deposit is received, the vet check is completed, and the remaining balance is received by Shirefox.

** Deposit is refunded if horse does not pass vet check.

A Horse Cannot Be Purchased Under The Terms Of A Quick Sale If:

  1. You have not first contacted Shirefox and both parties have agreed the horse is available under the terms of a 5-day “Quick Sale”;
  2. You are under the age of 18, or cannot legally enter into a contract;
  3. You need final approval from another person or trainer before committing to purchase the horse;
  4. You do not have funds available to wire transfer as a deposit;
  5. You do not have the funds to pay all vetting costs;
  6. You do not have funds available to pay the balance by wire transfer within 5 days from the date of entering into a “Quick Sale” agreement.

5-day Quick Sales are only for serious buyers who are eager, committed, and able to purchase a specific horse at a discount offered by Shirefox.

Can I Use Any Vet?

Shirefox can schedule a local vet upon buyer's request, or the buyer may arrange to have his/her own vet do the vet check so long as it falls within the timeline of a 5-day Quick Sale and Shirefox's receipt of deposit. The decisions of the veterinarian agreed by the buyer to perform the vet check, in either case, is considered final. Shirefox will immediately notify the buyer of the vet's findings as soon as they are available, and it is the buyer's responsibility to confirm the vet's findings with the veterinarian who performed the vet check in a timely fashion. Upon a passing vet check by the attending veterinarian, the full balance is due within the timeline of a 5-day Quick Sale. Deposits are non-refundable after a passing vet check. If horse does not pass vet check, the deposit is refunded to the buyer. All costs for vet checks are the responsibility of the buyer. Shirefox is not responsible for vet's findings, or lack thereof. Veterinarians are ultimately responsible for their own findings. If the buyer has specific questions or concerns, these need to be directly communicated between the buyer and the veterinarian prior to the vet's examination.

Why Do We Offer A Quick Sale Incentive?

We have had sales held up for weeks waiting for out of state vets, buyers on vacations or away at shows, buyers waiting on funds, and other unforeseen delays. These delays can seriously compromise potential sales to other parties that are interested in purchasing the same horse. In an effort to be fair to other serious buyers, we sometimes offer negotiable prices on Shirefox horses under the terms of a Quick Sale. This allows the buyer to take advantage of a 5-day Quick Sale discount, and eliminates conflicts with other interested parties.

Are All Horses Negotiable For Quick Sale?

Serious buyers are encouraged to call on any horse offered for sale by Shirefox and discuss a negotiable discount for a 5-day Quick Sale.

Policies for Consigned Horse Sales

Clients who want their horses represented and promoted for sale by Shirefox Farm will be expected and agree to give Shirefox Farm the full exclusive with all listings completely exclusive to Shirefox Farm and its owner or agents.

Clients will be expected to not list their horses for the duration that Shirefox Farm has contracted and negotiated for that particular horse or horses.

Clients will be expected to have professional photos ready of their horses acceptable to Shirefox Farm or hire Shirefox Photography to photograph their horse for sale.

All fees for advertising are the clients responsibility.

Clients will be expected to pay all grooming fees necessary for each presentation of their horse for sale and grooming must be to the standard of Shirefox Farm.

Clients will be expected to pay a 15% commission on the full sale price of the horse that is sold.

Sales for clients have a 90-day minimum "exclusive" and are responsible for all grooming and presentation time and expenses separate from commissions. 90 Day Exclusive to Restart with each presentation when horse is brought for grooming and sales presentation.

Restart of 90 day exclusive applies to horses in training and boarded on our facility being promoted for sale...so every time a horse is photographed for a new ad groomed or handled for sale that 90 day exclusive restarts. Exclusive means commission is paid regardless according to the agreed advertised sale price even if owner wants to sell sooner for less or to be negotiated. This also applies to horses that are not on our facility as well.

All grooming handling and presentations are documented with detailed photographs.

Also be advised that horses while on our premises will always be regularly groomed and handled.

All photography fees will be paid in full before horses can leave premises if they are here for sales promotion. Photographs are necessary for promotion and sales to document current condition of the animals being represented by Shirefoxfarm and this is an ABSOLUTE requirement to do a good job for our owners to sell their horses to the best of our ability.

Absolutely no personal info or banking info will be given out until a buyer properly identifies themselves for Bank to Bank wire transfers as this protect both parties and is an immediate accounting for money being handled.

We can be easily identified and verified as honest and upright through many references of happy buyers and owners who have hired us for training and promotion. References available upon request.

Owners of horses contracting us to sell their horses have signed for us to be Seller/Agents and all transactions are done through Shirefoxfarm and it owners so wire transfers are sent to us and we forward all monies to owners after all commissions board and others expenses are paid.

Owners would not give us this authority if they did not trust us so rest assured we are protecting all parties with honest and integrity and divulge all info pertaining to a horses heath and temperament and encourage any serious buyer to come stay at our barn and view the horses for themselves.

We have had to adopt these strict policies to prevent identity theft and keep our clients safe from the stressful abuses that can come from being approached by a potential buyer that may be up to no good and a waste of an owners precious time.

We graciously ask that you do not make an appointment unless you are a serious buyer that can afford the animal you are looking at and are looking at a time when you are ready to purchase.

Clients will be expected to understand that buyers are clients brought in by the hard work years of experience and good reputation of Shirefox Farm.  We do are best to have excellent photographs documentation and presentations of our quality horses.  We expect clients to not in any way, shape or form interfere with our sales of their horses as this can compromise a sale and our hard work.

ALL DAMAGES done to facilities BEYOND NORMAL WEAR AND TEAR ARE THE RESEPONSIBILITY OF THE HORSES OWNER. All boarding areas are documented and owners must be accountable for above and beyond normal wear and tear such as damaged fences and upheaval of normal footing (digging large holes ,trenching , etc)

We reserve the right to not show to clients that arrive with offensive material on their vehicles or person and we also do not allow smoking on the premises. We do not allow dogs on the premises without a leash and prior permission for the safety and well being of the horses and their riders/owners/trainers or observers.

We do not allow videos as we reserve the right to represent our own horses and would prefer you bring your trainer.

We also do not allow videos due to the volume of clients that come to our farm and our clients farms.  We do not know all these people personally and reserve the right to protect our clients personal privacy and property from theft due to video recording.

We do not raise or represent horses for consignment that have been run in herds or with other horses.

Horses need to be sound and healthy without shoes as xrays maybe be required during prepurchase exams so horses will only be recieved barefoot for us to represent them for sale

Policies for Payment Transfers

Shirefox Farm and its owners/agents are not responsible for fees charged for transferring payments to purchase horses and horses will not be released for transport until all board or any other fee pertaining to a sold horse must be paid in full prior to horses release for transport.  Shirefox Farm will charge a $20.00 per day fee for board or $550.00 per month to start at date of sale.

Washington State Tax applies to all sales.
